What Claims Could Be in a Xarelto Lawsuit?

Xarelto (Rivaroxaban) is produced by Bayer Pharmaceuticals and is marketed by Johnson & Johnson’s Janssen Pharmaceuticals unit. After it received the approval from the FDA in 2011, Xarelto is prescribed to block blood clots, specifically for those suffering from deep vein thrombosis (DVT). It is also prescribed for individuals with atrial fibrillation to reduce the risk of stroke caused by a blood clot.

Producing $5.74 billion in the last two years alone, Xarelto is one of the highest sales products for Bayer. Cutting this drug from the U.S. market would decimate the manufacturer’s sales to a massive percentage.

Unfortunately, with the rising number of bleeding lawsuit litigations on this drug, along with independent research showing the over-the-counter medications as equally effective, it will be tricky for Bayer to decry the imbalance between Xarelto benefits and side effects.

Risks involved in the medication

The patients prescribed with the medication have suffered from plenty of side effects, some of which are even fatal in nature. The victims filed for xarelto lawsuit to claims for the damage awards in terms of medical expenses, cost of hospitalization, loss of wages and more.

In the instances of an emergency situation, such as traumatic accident, or cerebral hemorrhage, the bleeding caused by Xarelto has been found to be difficult to stop.  As of January 2018, an antidote to the drug has still not been released to avert the severe, uncontrollable bleeding from occurring. Unmanageable severe bleeding events results in consequences such as gastrointestinal bleeds that can further the situation to blood transfusions, hospitalization, or even death.

The recent update on Xarelto cases

In March 2019, Johnson & Johnson and Bayer agreed to settle more than 25,000 lawsuits involving the blood thinner Xarelto and will pay $775 million to settle the cases on Xarelto lawsuit.

A jury would take into account the nature of the injuries from Xarelto, the severity of the damage in terms of the economic impact of the injury in calculating the amount of compensation to be awarded.

The following points are taken into consideration during negotiations:

•    The duration and extent of the injury from Xarelto

•    The effect that the drug injury had on the overall physical and mental well-being of the patient

•    The amount of any past or future medical expenses caused by Xarelto
•    Loss of wages or earning capacity in future
